Priyadarshini Mattoo Case : Part - 2
Response to the show cause notices, priyadarshini mattoo submitted explanation that she was a student of M.com. way back in 1991.Priyadarshini yet to appear in LL.B. IIIrd Year examination. In her explanation, In her explanation, priyadarshini told them about the repeated harassment of santosh singh from last one and half years. Priyadarshini told that the complaint was malicious. The result of the LL.B. 5th semester of priyadarshini was withheld by the university pending final decision on the said complaint.
And on 23.1.1996 priyadarshini has to go to university for her classes and her personal security officer, head constable rajinder singh got late and did not turn up at priyadarshini's home in time. So priyadarshini left for the university in her car with her parents who were also to visit tis hazari courts to attend some civil case. They left the residence at 9.15 a.m. They reached tis hazari courts at about 10.15 a.m. At tis hazari courts the parents of priyadarshini got down. Priyadarshini's PSO rajinder singh, who was to reach at her home, but he got late so he directly reached to university, where he saw santosh Singh was also present in the university again on his bullet motor cycle.
priyadarshini reached the university at about 10.30 a.m. she attended the class from 11.15 a.m. To 12 noon. Priyadarshini's friend manju bharti also saw santosh Singh there in the University on his black motorcycle wearing black colour helmet with a black visor. Priyadarshini attended her class and also filled her form of option for the subjects and left the university along with her security officer, Rajinder Singh in her maruti car. On way back priyadarshini also checked her parents, if they were available at tis hazari courts. On not finding them there, priyadarshini returned her home at about 1.45 p.m. On reaching home priyadarshini told constable rajinder singh that he go for now and should visit to her home at about 5.30 p.m., then she had her lunch.
And after that, around 2.30 p.m. the servant virender prasad went out to meet his friend who lives in safdarjung enclave, new delhi. Around 4.50 p.m. priyadarshini's neighbour shri k. uppuswami seen that santosh singh was standing near the door of the flat of Priyadarshini Mattoo towards the stair case. Then the servant virender prasad returned at about 4.55 p.m. The servant went for buying medicines and then again went out with the dog. And he saw santosh entering her house, apparently saying that he wanted a compromise in their legal complaints against him.
But after entering into her home, his intentions were not at all about of compromise on the complaints. He started again all his pleading and talking about his love, on priyadarshini's retalitation he got angry and raped her, and then he hit her face 14 times with a motorcycle helmet, and battered her face beyond recognition with a motorcycle helmet and after injured her, he finally strangled her with a wire of a room heater.
After raping and murdering her, santosh singh left her flat. Around 5.30 p.m. vasant kunj's security supervisor jaideep singh saw santosh singh near residence of priyadarshini. Advocate, shri o.p. singh, also seen that santosh singh getting out of the parking area of vasant kunj on his bullet motor cycle.
At about 5.30 p.m. PSO constable rajinder singh reached at priyadarshini's flat,he pressed the bell of the flat, but when no one responded,then rajinder singh went to the other door which was towards courtyard side. The door was knocked, again there was no response. It was then noticed that the door was open a bit. He went inside and entered in the bed room of priyadarshini and found that the body of priyadarshini was lying under the double bed. Seeing this, PSO constable rajinder singh became nervous. Rajinder singh came to the dining room of the flat of Priyadarshini and then telephoned and informed about the incidence at the police station vasant kunj that he is personal security officer of priyadarshini and she asked her to came at her flat around 5:30 P.M. and on arrival he saw priyadarshini mattoo is lying under the double bed, and there is no movement in her body, it appears that some incidence has taken place.
Santosh singh was studying at the indian law institute and the classes were generally from 6.10 p.m. to 7.30 p.m. and after murdering her santosh singh attended his class at ILI and reached about 5-10 minutes late in institute.
After lodgeding at the instance of rajinder singh additional SHO, along with
other police men, reached the place of crime.

And at about 7.30 p.m, priyadarshini's father C.L. Mattoo, reached at his flat, and he noticed people gathered at his house and crowd collected there, on enquiry, it came to his notice that his daughter, Priyadarshini is lying in her bed room, blood is oozing out from her mouth and on seeing it appears that someone has strangulated her.
He told the police that in morning after completing courts work, he and his wife went to safdarjung enclave on TSR scooter to attend the official meeting, from there his wife went to all india institute of medical sciences, and she also arrived at the house a little earlier. Immediately after the murder, the mother of priyadarshini raised suspicion that santosh singh had a hand in the murder of her daughter.
So Santosh Singh joined in the investigation during the night of 23rd and 24th January 1996. He was brought before Inspector Lalit Mohan and he noticed tenderness on his right hand and an injury which was not bandaged or plastered. He was also sent for a medical examination. Safdarjung Hospital examined him at 3.45 a.m. and found two injuries on his person - one a swelling on the right hand, and the second, scar marks old and healed multiple both lower limbs and on the chest. The Doctor also advised an X-ray of the right hand. Santosh Singh was thereafter allowed to go home and was directed to visit the Police Station at 9 a.m. on the 25th January 1996. The dead body was also subjected to a post-mortem on 25th January 1995 at the Safdarjung Hospital
Three years after the murder, on December 31, 1999, Santosh is set free by the trial court after it damned the CBI for failing to produce clinching evidence. The acquittal shattered public confidence in the legal system. The CBI too was shocked. A senior CBI official told Outlook: "The evidence was enough for the court to reach a conclusion but it was strange to see the judge setting the accused free."
Case was registered against santosh singh. During first days' of the court, santosh singh with his friends came in courts and tries to disturb the court proceeding. But however the court proceeding were strated. But santosh singh's father was a inspector general of police, and he done all effort to weaken the case, and in 1999 santosh singh set free by trial court. And he was happy and laughing while coming out from the court. After hearing the trial court's decision, priyadarshini's parents left delhi and settled in jammu for forever.
It's been years, but since murder, priyadarshini's father C.L. Mattoo hasn't gathered courage to enter Priyadarshini's room.
"It is very difficult to enter her room. It's still the way it was. I only take a look at it from a distance. Every morning I pray to her and thank her for giving me moral support and strength to go on," Mattoo said.
Priyadarshini's life was snuffed out, but the judicial reprieve gave Santosh an opportunity to continue rebuilding his. Three years ago he found a bride, one ranjana from Dehri-on-Son in Bihar. Close family friend and senior advocate Mahavir Prasad attended the wedding. Ranjana, he says, came from a wealthy landed Thakur family of Bihar.
It was an arranged marriage. The bride and groom's families knew each other. Prasad says that Ranjana's family were given all the details of the murder case and led to believe that his brush with the law was a thing of the past. While the Mattoo family was grieving for their daughter, Santosh's wedding in Dehri was well-attended. Local advocates, important citizens, friends and family all turned up
Life moved on for santosh and his bride. The couple moved into his parents' flat in model town, even though they had their own apartment in mayur vihar in east delhi.
In 2000, CBI appeals in delhi high court and on oct 30, 2006, the delhi police brought santosh singh to the court under heavy security and waited outside while the defence counsel and CBI advocates argued over the quantum of punishment, high court convicts santosh singh for raping and killing priyadarshini mattoo, and given death sentence to santosh singh. Santosh singh's face fell, turned pale when he was told that the court had given him the death sentence.
and his lawyers as if mourning in grief. He is likely to challenge the judgment in the Supreme court. Dressed in grey trousers and white shirt, Singh, a practising lawyer who is married and has a child, was crestfallen when the court handed down the verdict.Singh became emotional when his father came out of the court room and met him.

Santosh Kumar did not sleep well on monday night in jail after the court delivered its verdict that he would "hang till death". "He is shell shocked and is not talking freely. We have counselled him but, looking at the magnitude of punishment, it will be difficult to bring cheer to him," he said.
Santosh Kumar did not eat on Monday night or on Tuesday morning. "He was given dal, roti and vegetables last night and tea and bread this morning," said a top prison official.
On jan 23, 2007 santosh singh challenges conviction and death sentence in Supreme Court.
Santosh's lawyers have also argued that he should not be given the death sentence since he had a two-year-old child, a retarded brother and aged parents.
In its order, high court had earlier said that "santosh singh's crime was unpardonable. He was a lawyer himself and the son of a senior police officer. Yet, Santosh not only harassed priyadarshini mattoo time and again, but also went back on the written assurances and apologies that he had given to the delhi police, promising that he would mend his ways. Given his past conduct, the highest capital punishment possible is what santosh singh deserves."
Santosh's defence lawyers had also argued for life imprisonment for him, claiming that the injuries observed on Priyadarshini's body were not very grave.
Though the High Court has reversed a judgment of acquittal based on circumstantial evidence, santosh singh was a young man of 24 at the time of the incident and, after acquittal, had got married and is the father of a girl child. Also there was nothing to suggest that he would not be capable of reform. Though there were extremely aggravating circumstances as well. Nevertheless as per the supreme court the balance sheet tilted marginally in favour of santosh singh and the death sentence awarded to him was commuted to life imprisonment.
